When and How to Request a Modification or Termination

There is no fixed waiting period to file a petition for modification or termination. However, the court will only consider the request if there is a clear and compelling reason to do so. This may include a change in living circumstances, ongoing counseling or treatment, or the mutual agreement of both parties. In all cases, the court’s primary concern is whether continued protection is still necessary.

Once a petition is filed, a hearing will be scheduled. Both parties will have the opportunity to present evidence and testimony. The judge will then decide whether the order should be modified, extended, or dismissed entirely.

The court evaluates each request based on the original facts of the case, any new developments, and whether there’s any ongoing risk. In some cases, the protected party may no longer feel the need for an order. In others, the accused may show evidence of rehabilitation or changed behavior.
