Filing and Obtaining a PFA Order

Taking legal action to protect yourself or your children is never easy—but it’s often necessary. In Pennsylvania, individuals facing domestic abuse have the right to seek a Protection From Abuse (PFA) order through the court system. At Shane Scanlon Law, we help you understand the process, prepare your case, and move forward with confidence.

Who Can File for a PFA?

You may be eligible to file for a PFA if the abuse comes from someone with whom you have a close personal relationship. That can include a spouse or ex-partner, someone you live with or used to live with, a family member, or the other parent of your child. Abuse may involve physical harm, threats, stalking, or serious emotional intimidation.

The Filing Process

The process begins by submitting a petition at your county courthouse. In urgent situations, a temporary (ex parte) PFA can be issued the same day—without the accused present—offering immediate protection. This order typically lasts until a final hearing is scheduled, usually within 10 business days.

Temporary vs. Final Orders

A temporary PFA is just that—temporary. A final PFA order can last up to three years and is only issued after a formal hearing where both sides have the opportunity to present evidence. At this stage, legal representation becomes critical.

What to Expect in Court

Court hearings move quickly, and preparation is key. We’ll help you gather documentation, prepare your statement, and make sure your petition is clear and compelling. Our team will be by your side to advocate for your safety and ensure your rights are protected at every step.
